Police Shooting Death Leads to Federal Suit

The family of a man shot and killed by a Madera police officer while sitting handcuffed in a police car has filed suit in federal court.
Arturo Gonzalez, the family’s attorney, said no specific monetary claim was included in his clients’ lawsuit, filed Thursday in U.S. District Court. They want a jury to decide the value of Everardo Torres’ life.
On Monday, Torres’ family filed a $10-million claim against the city of Madera, accusing Officer Marcy Noriega and other officers of using excessive and unreasonable force when dealing with Torres while breaking up a party on Oct. 27.
Investigators say Noriega accidentally pulled out her handgun, instead of her Taser, and shot Torres in the chest to stop him from kicking out the police car’s rear window.
