From Times Wire Reports
Prosecutors who won a conviction of David Westerfield in the kidnapping and murder of Danielle van Dam said Monday there is no evidence the girl died in her bedroom, a theory the defense raised in seeking to delay his sentencing.
Westerfield is to be sentenced Friday.
Superior Court Judge William Mudd has the option of sentencing him either to death, as a jury recommended, or to life in prison without parole.
In response to defense motions, prosecutors urged Mudd to reject the request for a delay.
