Decision Postponed on Retrial in Murder Case

A decision on whether to retry a Los Angeles woman who had served 17 years in prison when her murder conviction was overturned has been postponed until Nov. 12.
Marva Wallace was freed from state prison Friday after Los Angeles Superior Court Judge David S. Wesley ruled that the outcome of her 1985 trial probably would have been different if evidence of battered women’s syndrome had been allowed in her defense.
Wallace’s attorney, Michael Brennan, said after a hearing Monday that he hopes to use the time to talk to prosecutors about the possibility of dropping any further proceedings against her.
The judge overturned the murder conviction two weeks after Gov. Gray Davis denied Wallace parole.
